Information notice concerning the processing of personal data carried out by “Monitorul Oficial” Autonomous Regie

Purposes and legal basis of the processing

In accordance with the national (Law no. 202/1998, as republished, as subsequently amended and supplemented, Law no. 190/2018) and EU legislation (Regulation 2016/679/EU, Directive 2016/680/EC, Directive 2002/58/EC) in force, “Monitorul Oficial” Autonomous Regie has the obligation to manage the personal data provided to it securely and only for the specified purposes.

“Monitorul Oficial” Autonomous Regie processes your personal data in accordance with the provisions of GDPR, as controller, through its services/offices/departments, in accordance with the specific applicable laws, in order to:

  • o include publication notices in Monitorul Oficial al României (the Official Gazette of Romania);
  • o engage in public relations activities/answer petitions/formulate standpoints at the request of natural persons;
  • o enter into various contracts; o grant subscriptions to the Official Gazette of Romania;
  • o employ personnel; o send commercial offers (newsletter);
  • o bring legal actions and ensure representation in court.

If you do not agree to provide your personal data, “Monitorul Oficial” Autonomous Regie, through its services/offices/departments, cannot take the legal steps required to answer your petitions, respond to requested standpoints, grant subscriptions, enter into contracts, participate in competitions, hire personnel etc.

Legal basis of data processing

Your personal data is processed for compliance with the legal obligations to which the controller (“Monitorul Oficial” Autonomous Regie) is subject, according to Article 6 of the GDPR.

The main laws governing the activities carried out by the services/offices/departments within the “Monitorul Oficial” Autonomous Regie are the following: 

  • Law no. 202/1998 on the organisation of the Official Gazette of Romania, as republished, as subsequently amended and supplemented; 
  • Government Decision no. 844/2018 on the organisation and functioning of “Monitorul Oficial” Autonomous Regie; 
  • Regulation 2016/679/EU, Directive 2016/680/EC, Directive 2002/58/EC; 
  • Law no. 190/2018 on measures for the implementation of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation); 
  • Law no. 544/2004 on the free access to public interest information, as subsequently amended and supplemented; 
  • Government Ordinance no. 27/2002 on the regulation of the petition resolution activity, as subsequently amended and supplemented; 
  • the Civil Procedure Code.

Types of personal data we process

The personal data protection and security policy of “Monitorul Oficial” Autonomous Regie is to collect only the personal data necessary for the purposes mentioned and to request data subjects to communicate to us only those personal data that are strictly necessary to fulfil these purposes.

The categories of personal data (either classical or digital) subject to processing in the services/offices/departments within the “Monitorul Oficial” Autonomous Regie are the following:

For the advertisements published in the Official Gazette of Romania: 

  • first name, last name;
  • signature;
  • contact details – the personal telephone number, email address, domicile/residence address etc.;
  • series and number of identity card/identity document;
  • personal numerical code (CNP).

For public relations/petitions/complaints/notifications/views presented in response to requests made by natural persons: 

  • first name, last name;
  • signature;
  • contact details – personal telephone number, email address, domicile/residence address etc.;
  • series and number of identity card/identity document;
  • personal numerical code.

For legal actions and representation in court:

  • first name, last name;
  • signature;
  • contact details – personal telephone number, email address, domicile/residence address, etc.;
  • series and number of identity card/identity document;
  • personal numerical code.

For entering into contracts/granting subscriptions:

  • first name, last name;
  • signature;
  • contact details – personal telephone number, email address, domicile/residence address etc.;
  • series and number of identity card/identity document;
  • personal numerical code.

We reserve the right to request other data necessary for the performance of the duties of the services/offices/departments of “Monitorul Oficial” Autonomous Regie, strictly in accordance with legal provisions.

Source of personal data

“Monitorul Oficial” Autonomous Regie, through its services/offices/departments, collects personal data directly from you, from third parties (such as other institutions or entities contacting the Regie or other data subjects) or from public documents.

If we need to process personal data obtained from third party legal entities, the latter have the obligation to provide you with the necessary information concerning the use of the personal data transmitted.

Categories of recipients of personal data

Your personal data are intended for use by the controller (“Monitorul Oficial” Autonomous Regie) and are communicated to the following recipients, if applicable:

  • other central and local institutions/authorities, in accordance with the law, or for re-direction of wrongly addressed petitions, in accordance with the law;
  • the courts of law, for legal actions and representation in court.

The data shall be disclosed to third parties in accordance with the law for the categories of recipients mentioned above.

The personal data storage period

Your personal data are stored for the period necessary to fulfil the duties granted by law, after which they will be archived according to the applicable legislation.

Your rights and how to exercise them

In accordance with applicable laws, you benefit from the right of access to personal data, right to rectification, right to erasure, right to restriction of processing, right to data portability, and right to object.

Special or consent-based data processing

When the processing is based on point (a) of Article 6(1) of the GDPR, “the data subject has given consent to the processing of his or her personal data for one or more specific purposes”, you have the right to withdraw your consent at any time without affecting the lawfulness of the processing carried out based on your consent prior to its withdrawal. Thus, you can change or eliminate your consent at any time and we shall act immediately accordingly, unless there is a legal reason or legitimate interest not to do so.
